These Terms of Use ("Terms") govern your access to and use of the services provided by MainMarket, Inc. ("MainMarket," "we," "us," or "our"), including the Cart by MainMarket mobile application ("Cart"), the Scout by MainMarket mobile application ("Scout"), and the MainMarket website and data platform. By accessing or using any of our services, you agree to be bound by these Terms.
You must be at least 18 years of age to use our services. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Consumer Grocery App
Cart is a free consumer application that allows you to browse grocery pricing and product availability at stores near you, create and manage grocery lists, and track prices over time. Cart is an informational tool — you cannot purchase products through the app.
Pricing and availability information displayed in Cart is collected from real stores and updated regularly, but we do not guarantee that it is accurate, complete, or current at the time you view it. Prices may vary due to in-store promotions, regional differences, or timing of data collection. Always verify prices at the point of purchase. MainMarket is not responsible for discrepancies between displayed prices and actual in-store prices.
You agree to use Cart for personal, non-commercial purposes only. You may not:

Scouts are independent contractors, not employees of MainMarket. Nothing in these Terms creates an employment, partnership, or agency relationship. You are solely responsible for your own taxes, insurance, and compliance with applicable labor laws. MainMarket does not withhold taxes on your behalf.
When you accept a scan job, you agree to:
MainMarket provides a lanyard phone case at no cost to active Scouts. This equipment remains the property of MainMarket and must be returned if your account is deactivated. You are responsible for providing your own compatible iPhone (iPhone 12 or newer) and maintaining it in working condition.
Payment for each completed scan is displayed upfront before you accept the job. Payment is released after your scan passes quality review. Payments are processed instantly via Stripe Connect to your linked account. MainMarket reserves the right to withhold payment for scans that fail quality review due to incomplete coverage, intentional obstruction, or fraudulent activity.
MainMarket reviews all scans for quality and integrity. We reserve the right to reject scans and suspend or permanently deactivate your Scout account if we detect:
Either you or MainMarket may terminate your Scout account at any time. MainMarket may deactivate your account immediately and without notice if we reasonably believe you have violated these Terms or engaged in fraudulent activity. Upon termination, any pending payments for approved scans will still be processed.
All content, data, software, trademarks, and other intellectual property associated with MainMarket's services are owned by or licensed to MainMarket, Inc. You may not copy, modify, distribute, or create derivative works from any part of our services without our prior written consent. Pricing and product data collected through the Scout app and displayed through the Cart app is the exclusive property of MainMarket.
To the maximum extent permitted by applicable law, MainMarket and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability for any claim arising from these Terms shall not exceed the amount paid to you (for Scouts) or paid by you (for other users) in the twelve months preceding the claim.
Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. We make no guarantees regarding the accuracy of pricing or product data.
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in New York County, New York.
We may update these Terms from time to time. If we make material changes, we will notify you through the app, by email, or by posting a notice on our website. Your continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
